- People who validly opt out on time, governmental entities, the Parties' lawyers and their law firms, Festival Fun Parks and its parents, affiliates, subsidiaries, independent service providers and their employees, officers and directors, and the presiding judicial officer, immediate family and judicial staff are excluded
- Any person or entity that entered into a release with Festival Fun Parks before the Court's final approval of the Settlement arising from the same processing-fee allegations on ragingwaters.com is excluded
